By accessing or using the Service, you agree to be bound by these Terms and all applicable laws and regulations. If you do not agree with any part of these Terms, you may not use the Service.

We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Service after any changes indicates your acceptance of the updated Terms. The date of the latest version will be reflected in the "Effective Date" at the top of this document.

3. Description of Service

Dopler is a platform that allows businesses or individuals to create and manage waitlists, and allows respondents to sign up for those waitlists. As a customer (a business or individual with a Dopler account), you can collect email addresses and other relevant information from respondents who choose to join your waitlist.

4. Eligibility

You must be at least 18 years old or the legal age of majority in your jurisdiction to use the Service. By using the Service, you confirm that you meet this eligibility requirement.

5. Account Registration

To use Dopler as a customer, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account login credentials and for any activities that occur under your account. If you suspect any unauthorized use of your account, please notify us immediately.

6. Use of Service

You agree to use the Service only for lawful purposes and in accordance with these Terms. You are responsible for ensuring that your use of the Service, including your interactions with respondents, complies with all applicable laws, regulations, and industry standards, including but not limited to privacy laws such as the GDPR and CCPA.As a customer, you are responsible for maintaining the privacy and confidentiality of any data you collect through your waitlists. You must clearly inform respondents of how their data will be used and processed, and ensure that you obtain proper consent from respondents where required.

7. Data Privacy and Security

Your use of the Service is subject to our Privacy Policy. By using the Service, you consent to the collection, use, and disclosure of your information as described in the Privacy Policy.

8. Payment Terms

If you purchase a paid version of the Service, you agree to pay all applicable fees as described during the registration process. Payment will be processed through our third-party payment processor, Stripe. All payments are non-refundable unless otherwise required by law.

9. Intellectual Property

All content, materials, and intellectual property available through the Service, including but not limited to software, graphics, text, and logos, are owned by Dopler or its licensors and are protected by applicable intellectual property laws. You agree not to copy, modify, distribute, or reverse engineer any part of the Service without express permission from Dopler.

10. Prohibited Conduct

You agree not to:
  • Use the Service for any illegal, harmful, or fraudulent purpose.
  • Impersonate any person or entity, or falsely state or misrepresent your affiliation with a person or entity.
  • Interfere with or disrupt the Service or servers or networks connected to the Service.
  • Use any automated systems, including bots or scrapers, to access the Service.

11. Termination

We reserve the right to suspend or terminate your access to the Service at any time, without notice, for any reason, including for a breach of these Terms. Upon termination, your right to use the Service will cease immediately, and we may delete your account and any associated data.

12. Disclaimer of Warranties

The Service is provided on an "as-is" and "as-available" basis. Dopler makes no warranties, expressed or implied, regarding the availability, performance, or security of the Service. We disclaim any implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

13. Limitation of Liability

To the fullest extent permitted by law, Dopler shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, including but not limited to loss of profits, data, or goodwill.In no event shall Dopler's total liability to you for all damages, losses, or causes of action exceed the amount paid by you, if any, for accessing the Service during the twelve (12) months preceding the date of your claim.

14. Indemnification

You agree to indemnify and hold harmless Dopler, its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of Hungary, without regard to its conflict of law principles. Any disputes arising from these Terms or your use of the Service will be subject to the exclusive jurisdiction of the courts of Hungary.
